1. Acceptance of Terms
By accessing, playing, or purchasing from Artbitrator, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our service.
2. Description of Service
Artbitrator is a free multiplayer drawing game where players create drawings based on prompts and are judged by artificial intelligence. The service includes:
- Multiplayer drawing modes (1–12 players)
- Draw All The Things collection mode
- Weekly Challenges with leaderboards
- Story Mode and Free Draw
- Paint Your Partner couples drawing challenge
- Ketchphrase phrase-guessing game
- A public gallery of player drawings
- An optional merchandise store where players can purchase physical products featuring their artwork
3. User Conduct
You agree NOT to:
- Create drawings containing offensive, hateful, sexually explicit, or inappropriate content
- Harass, bully, or abuse other players
- Cheat, exploit bugs, or use unauthorized third-party software
- Impersonate others or create fake accounts
- Spam chat, voice channels, or use the game for advertising
- Attempt to hack, disrupt, or damage the game servers
- Share or distribute copyrighted material without permission
- Use automated tools, bots, or scripts to interact with the service
- Scrape, bulk download, copy, or systematically extract drawings, images, or any other content from the game or website
- Redistribute, republish, or repost player drawings from the gallery or game without written permission from Artbitrator
- Use any content from Artbitrator (including player drawings) for commercial purposes, datasets, AI training, or any other use outside the game
4. Content Ownership & Licensing
4.1 Your Drawings
You retain ownership of the drawings you create in Artbitrator. By using the service, you grant us a worldwide, non-exclusive, royalty-free, perpetual, sublicensable licence to use, display, reproduce, modify, and distribute your drawings for the following purposes:
- Operating, maintaining, and improving the game and its features
- Displaying your drawings in the public gallery, leaderboards, and player profiles
- Creating composite images such as mosaics, collages, and background artwork using multiple player drawings
- Promotional and marketing materials including social media, the website, app store listings, and advertising
- Sharing with other players during matches and in community features
4.2 Merchandise & Commercial Use
Artbitrator may offer merchandise products (mugs, prints, posters, apparel, etc.) featuring player artwork. There are two types of merchandise use:
- Player-initiated merchandise: When you choose to purchase a product featuring your own drawing (or a drawing created during a session you participated in, such as Paint Your Partner), you are requesting that we produce that product for you. No additional consent is needed beyond placing the order.
- Community merchandise: We may create products featuring curated collections, mosaics, or composites that include drawings from multiple players. By using the service, you agree that your drawings may be included in such community products. Individual drawings will not be the sole or primary focus of community merchandise without the creator's explicit consent.
By using the service, you grant us the right to use your drawings on merchandise we sell, whether as individual prints, curated collections, mosaics, or any other format. This includes sales through our own store, third-party marketplaces, or any other sales channel. Only Artbitrator (and its authorised partners) may sell merchandise featuring player drawings — players may not independently sell products featuring content created within the game. If you do not wish your drawings to be used on merchandise, you may contact us to opt out at any time.
4.3 Public Gallery & Image Protection
Drawings submitted during gameplay may appear in our public gallery at artbitrator.com/gallery and may be visible to anyone on the internet. Drawings may also be used in dynamically generated mosaic images displayed across the website and within the game.
All drawings displayed in the gallery, within the game, and across our website are protected by copyright. The gallery is provided for viewing purposes only. You may not download, copy, screenshot for redistribution, scrape, or otherwise extract drawings from the gallery or any part of the service. You may not repost, reshare, or redistribute any player drawings on other websites, social media, datasets, or any other medium without prior written permission from Artbitrator.
We actively monitor for unauthorised use of our content and will pursue takedown requests (DMCA / copyright notices) against any individual or service that copies, hosts, or distributes drawings from Artbitrator without permission.
If you would like a specific drawing of yours removed from the public gallery, please contact us.
4.4 Our Content
All game code, AI models, graphics, audio, text, player drawings hosted on our platform, and other content provided by or through Artbitrator are owned by us or licensed to us and protected by copyright and other intellectual property laws. The compilation, arrangement, and presentation of player drawings (including gallery pages, mosaics, and curated collections) constitute our creative work and are separately protected. You may not copy, modify, distribute, or create derivative works from any content on our platform without written permission.
5. Purchases & Merchandise
5.1 Orders & Pricing
All merchandise prices are displayed at checkout and include the product cost. Shipping costs and applicable taxes are calculated and shown before you confirm your order. By placing an order, you agree to pay the total amount displayed.
5.2 Fulfilment
Merchandise is produced and shipped by third-party print-on-demand partners on our behalf. Each item is made to order. Production typically takes 2–7 business days, and shipping times vary by location. We will provide tracking information where available.
5.3 Refunds & Returns
Because all merchandise is custom-printed, we cannot accept returns for change of mind. However, we will replace or refund products that:
- Arrive damaged or defective
- Have significant print quality issues
- Are the wrong item or size due to a fulfilment error
Refund requests must be submitted within 30 days of delivery with a photo of the issue. Contact us via the channels listed in Section 15.
5.4 Payment Processing
Payments are processed securely by third-party payment providers. We do not store your full payment card details. All transactions are subject to the payment provider's own terms of service.
6. Privacy & Data
Our collection and use of personal data is governed by our Privacy Policy. By using Artbitrator, you acknowledge that we may collect:
- Account information (username, email if provided)
- Gameplay data (drawings, scores, session history)
- Technical data (device type, browser, IP address for analytics)
- Purchase and shipping information (for merchandise orders only)
We use analytics tools to understand how players use the game and to improve the experience. We do not sell your personal data to third parties.
7. Age Restrictions
You must be at least 13 years old to use Artbitrator. Users between 13 and 18 should have parental or guardian consent before using the service. By using the service, you represent that you meet these age requirements.
To make merchandise purchases, you must be at least 18 years old or have the consent and involvement of a parent or guardian.
8. Fair Play
We want Artbitrator to be fun and fair for everyone:
- No using AI tools or image generators to create drawings
- No pre-drawing, tracing, or uploading saved images
- No collusion or match-fixing in multiplayer games
- No exploiting bugs or glitches for competitive advantage
- Play in good faith and respect other players
9. Beta Features
Some features of Artbitrator may be in beta or early access. These features may contain bugs, may be interrupted, and may change or be removed without notice. We do not guarantee continuous availability or specific performance levels for beta features.
10. Account Suspension & Termination
We reserve the right to suspend or terminate your access to the game at any time, with or without notice, for:
- Violations of these Terms
- Creating offensive or inappropriate content
- Cheating or fair play violations
- Any other reason we deem necessary to protect the community
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
- Merchantability or fitness for a particular purpose
- Accuracy or reliability of AI judgments or voice commentary
- Uninterrupted or error-free operation
- Security of data transmission
- Quality, colour accuracy, or delivery timelines of merchandise produced by third-party fulfilment partners
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICE OR PURCHASE OF MERCHANDISE. OUR TOTAL LIABILITY FOR ANY MERCHANDISE CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT IN QUESTION.
13. Modifications to Terms
We may modify these Terms at any time. Continued use of the service after changes constitutes acceptance of the modified Terms. For significant changes (particularly to content licensing or merchandise terms), we will make reasonable efforts to notify users via in-game notice, email, or our Discord server.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in these Terms affects your statutory rights as a consumer.

Summary (Not Legal Advice): The game is free, be respectful, don't cheat, and have fun drawing! Your drawings are yours, but we can show them in the gallery, use them in mosaics, promo materials, and on merchandise we sell. If you buy merch with your own art on it, a third-party printer makes and ships it. You can opt out of merchandise use or request gallery removal by contacting us.
